This Refund / Cancellation Policy applies to bookings made through www.realbajatours.com, by WhatsApp, email, social media, phone, or any other authorized booking channel of REAL BAJA TOURS AND TRAVEL LLC (“Real Baja Tours”).
By making a reservation with Real Baja Tours, the customer acknowledges and accepts the following refund, cancellation, rescheduling, and no-show terms.
1. General Policy
Real Baja Tours offers guided tours, adventure experiences, transportation-related arrangements, and related travel services that require availability planning, operational logistics, staffing, equipment, transportation coordination, and time-slot allocation.
For this reason, all cancellations, changes, and refunds are subject to the present Policy.
2. Customer Cancellation Rule
The following rule applies exactly as part of this Policy:
For a full refund, you must cancel at least 24 hours before the experience’s start time.
If you cancel less than 24 hours before the experience’s start time, the amount you paid will not be refunded.
Any changes made less than 24 hours before the experience’s start time will not be accepted.
Cut-off times are based on the experience’s local time.

3. How to Cancel
To request a cancellation, the customer must contact Real Baja Tours through one of the official communication channels made available by the business, including email, WhatsApp, phone, or any other verified booking channel used for the reservation.
A cancellation request will only be considered received once it has been actually delivered through an official contact channel and can be reasonably identified by our team.
The customer should provide enough information to identify the booking, including:
full name,
booking date,
tour or service booked,
contact details,
and proof of payment or booking reference where available.
4. Refund Eligibility
A customer will generally be eligible for a full refund only if the cancellation request is made at least 24 hours before the experience’s start time, calculated according to the local time of the booked experience.
No refund will be issued when:
the cancellation is made less than 24 hours before the experience’s start time;
the customer fails to appear;
the customer arrives too late and misses the experience;
the customer cannot participate due to reasons not attributable to Real Baja Tours, including but not limited to lack of required readiness, failure to appear at pickup, inability to be contacted, or personal scheduling conflicts.
5. Changes and Rescheduling Requested by the Customer
Changes, modifications, or rescheduling requests are subject to availability and operational feasibility.
Any changes made less than 24 hours before the experience’s start time will not be accepted.
Requests submitted at least 24 hours in advance may be considered, but approval is not guaranteed and remains subject to:
availability,
seasonality,
operational logistics,
weather or route conditions,
and any third-party limitations affecting the experience.
6. No-Shows
If the customer does not attend the activity, does not arrive at the pickup point or meeting point on time, does not answer attempts to contact them, or otherwise fails to present themselves for the service, the booking may be classified as a no-show.
No-shows are non-refundable.
7. Cancellations or Changes by Real Baja Tours
Real Baja Tours reserves the right to cancel, modify, delay, or reschedule an experience for reasons including, but not limited to:
unsafe weather or sea conditions,
route or park restrictions,
mechanical issues,
equipment or guide unavailability,
safety concerns,
force majeure,
government restrictions,
or other operational circumstances beyond our reasonable control.
In such cases, Real Baja Tours may offer one of the following remedies, depending on the circumstances:
rescheduling to another available date or time;
issuing a credit for future use;
issuing a full or partial refund of the amount actually paid, where appropriate.
If a cancellation is due solely to Real Baja Tours and no reasonable alternative can be offered, we will generally aim to refund the amount paid for the affected service.
8. Weather and Safety Conditions
Many Real Baja Tours experiences take place outdoors and may be affected by weather, road, ocean, trail, or operational safety conditions.
For safety reasons, Real Baja Tours may modify routes, shorten an experience, change timing, or cancel an activity if conditions are considered unsafe.
A modification made for safety reasons does not automatically entitle the customer to a refund, provided that the essential nature of the booked service can still be delivered in a reasonably equivalent way.
9. Processing of Refunds
Approved refunds will be processed to the original payment method whenever reasonably possible. If that is not possible, Real Baja Tours may use another lawful method agreed with the customer.
Refund timing may vary depending on:
the payment processor,
the customer’s bank,
platform processing times,
weekends or public holidays,
and the verification of the original transaction.
Any fees retained by banks, payment processors, exchange-rate providers, or third-party platforms that are outside the direct control of Real Baja Tours may be deducted or may not be recoverable, unless mandatory law requires otherwise.
10. Partial Use of Services
If a customer voluntarily leaves an activity early, refuses to participate after the service has begun, or does not use part of the booked service for personal reasons, no full or partial refund will generally be granted.
11. Force Majeure
Real Baja Tours shall not be liable for failure or delay in performance caused by events beyond its reasonable control, including acts of God, hurricanes, storms, road closures, public authority restrictions, accidents, strikes, security events, public health events, war, civil unrest, power outages, or third-party transport failures.
In such cases, Real Baja Tours will make reasonable efforts to offer an alternative, but a refund may be subject to the actual circumstances, non-recoverable costs, and applicable law.
12. Chargebacks and Payment Disputes
Before initiating a chargeback or payment dispute with a bank or payment provider, the customer agrees to first contact Real Baja Tours in good faith to attempt a direct resolution.
Where a chargeback is filed fraudulently, abusively, or contrary to this Policy and the customer’s accepted booking terms, Real Baja Tours reserves the right to submit supporting evidence to the relevant financial institution or platform.
13. Relation to Other Policies
This Refund / Cancellation Policy forms an integral part of the Terms and Conditions of Real Baja Tours.
In the event of any conflict between this Policy and general booking communications, this Policy shall prevail unless otherwise agreed expressly in writing.
14. Amendments
Real Baja Tours reserves the right to amend this Refund / Cancellation Policy at any time to reflect changes in operations, law, payment providers, seasonal conditions, or booking practices.
The version published on the Website at the time of booking shall generally apply, unless mandatory law requires otherwise.
